These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ThetaDriven Inc. ("The Company," "we," "us," or "our") governing your access to and use of the ThetaDriven platform, including all associated services, APIs, and documentation (collectively, "The Service" or "The Platform").
By accessing or using The Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
By accessing or using The Platform, you agree to these Terms. If you are using The Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use The Service.
ThetaDriven Inc. provides a deterministic identity and decision-support platform utilizing the Tesseract Protocol and Fractal Identity Map (FIM) technology. The Service includes:
To access certain features of The Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify The Company immediately of any unauthorized use of your account.
The Platform utilizes artificial intelligence and machine learning technologies to provide coaching, analysis, and decision support. You acknowledge that:

We retain your data only for as long as necessary to provide The Service and comply with legal obligations. You may request deletion of your data at any time, subject to legal retention requirements.
"Fuel" is a consumable license key used to prioritize computational requests within the Tesseract Protocol. Fuel is NOT:
Fuel may be purchased through The Platform at prices determined by The Company. All purchases are final and non-refundable except as required by applicable law. Unused Fuel does not expire but may be subject to adjustment if pricing changes.
The Company may, at its sole discretion, develop blockchain-based features for protocol governance. Any future tokens will be utility tokens for protocol governance purposes only, not speculative assets. Such features, if implemented, will be subject to separate terms and applicable regulatory requirements.
You agree to use The Service only for lawful purposes. You shall not:
The Service, including all content, features, and functionality, is owned by ThetaDriven Inc. and is protected by intellectual property laws. The Tesseract Protocol and Fractal Identity Map (FIM) technology are proprietary to The Company.
You retain ownership of content you submit to The Service. By submitting content, you grant The Company a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely to provide and improve The Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Any performance metrics, improvement estimates, or outcome projections provided by The Service are based on statistical models and simulations. Actual results may vary based on individual circumstances and implementation. The Company makes no guarantees regarding specific outcomes.
You agree to indemnify and hold harmless ThetaDriven Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of The Service or violation of these Terms.
Either party may terminate this agreement at any time. The Company may suspend or terminate your access to The Service immediately if you breach these Terms. Upon termination, your right to use The Service ceases immediately, though certain provisions of these Terms will survive termination.
The Company reserves the right to modify these Terms at any time. Material changes will be communicated via email or through The Platform at least thirty (30) days before taking effect. Continued use of The Service after changes become effective constitutes acceptance of the modified Terms.
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Portions of The Service produce attestation artifacts — placement and drift receipts, counterparty endorsements, and circle documents binding the two. The following governs them and controls over any general statement elsewhere in these Terms or on the site.
An attestation artifact records where a declared action landed against a declared scope of authority. That placement is deterministic, produced without any language model in the verdict path, and independently recomputable. The Company makes no claim that an action was correct, safe, compliant, or free of defects — for non-trivial semantic properties no such general determination is available to any software, and none is asserted here. The Company further makes no claim that a placement outside a declared scope causes, predicts, or quantifies a loss of any amount. Any correlation between placement and financial outcome is the modelling responsibility of the party performing it.
The Company does not underwrite, place, broker, adjust, or settle insurance or any other financial instrument, and holds no position in any risk referencing its outputs. The Company licenses measurement software and the instrument layer described in its published dual license; it does not provide insurance, legal, actuarial, accounting, or investment advice. Figures appearing in marketing materials, including illustrative liability magnitudes, are illustrative and not an estimate of any reader's exposure. No content on the site or in an attestation artifact constitutes an offer of coverage or a representation that coverage exists, will be available, or will respond to any loss.
Any person may read the specification, run the math, fork the runtime, and recompute or independently verify any attestation artifact — including artifacts issued by The Company — perpetually, without permission and without fee. The Company does not adjudicate whose attestation any third party must accept; a verifying party names for itself which signing keys it honours. This right is granted irrevocably in the published license and no commercial agreement conditions or withdraws it.
The verdict path contains no language model and no other probabilistic component, so the same inputs produce the same artifact on any machine. The Company's participation is therefore not a dependency in verifying, disputing, or acting on an artifact, and The Company does not undertake to participate. If two runs over identical inputs produce different artifacts, the artifact is not what these Terms describe and no party should rely on it.
Running, forking, and verifying the software is free under the open-source grant. Building, operating, or monetizing a financial instrument — insurance, reinsurance, bonds, options, derivatives, parametric triggers, or clearing services — whose trigger, exclusion, premium, coverage, or settlement references an attestation artifact requires a separate written commercial license from The Company. This applies to the act of instrument-building regardless of which party's runtime or signing key produced the artifact. Full terms: the dual license published with the software.
A party choosing to rely on an attestation artifact for any consequential decision is responsible for verifying it independently — the means to do so are provided unconditionally under 15.3 — and for satisfying itself as to fitness for that party's purpose. Attestation artifacts are provided AS IS, and Section 9 applies to them in full.
The scope of authority an attestation artifact is measured against is declared by you, recorded before the measured action, and is the only baseline used. The Company does not define, infer, or hold an ideal, optimal, or correct state of your work, and no artifact is measured against one. It follows that the resolution of the measurement is the resolution of your declaration: a scope declared broadly is measured broadly, and that consequence is yours.
Where an attestation artifact is used as an input to any decision, trigger, or instrument, it supplies one fact — where a declared action landed against your declared scope. Any second fact — a reported problem, a business metric, a complaint, an adjuster's finding, or any other indicator of outcome — is supplied by you or by a third party, is outside The Company's knowledge, and is not verified, weighted, corroborated, or adopted by The Company. Any conclusion drawn from combining them is drawn by the party combining them.
An artifact recording that an action landed within a declared scope is not a representation, warranty, or indication that the action was good, correct, safe, compliant, fit for purpose, or free of defects, and must not be presented to any third party as though it were. Work of poor quality may land entirely within a declared scope, and an artifact recording that fact is functioning as specified rather than reporting an error. The Company measures placement and does not measure, score, grade, or certify quality or correctness, and nothing in The Service should be relied upon as doing so.

10. A phone number you submit is used only to call you back — never sold, never added to a marketing list, deleted on request.
11. The scope an attestation is measured against is declared by you; ThetaDriven holds no ideal or correct state of your work and measures against none.
12. An attestation supplies one fact — where the action landed. Any second fact about outcome is yours, and combining them is your conclusion, not ours.
13. Landing within scope is not a representation that the work was good. Poor work can sit entirely within a declared scope, and recording that is the instrument working.
